Allowances

The allowances for police officers are differentiated between official allowances and position allowances. The official allowances are irrevocable and pensionable. Job allowances are paid, for example, as ministerial allowances. They are both revocable and not pensionable in all cases.

Performance allowance: What allowances do police officers get?

In 1997, the motivation of civil servants was to be increased by means of performance bonuses and performance bonuses. The performance allowance is paid when a positive performance forecast is made. It is only a temporary payment and can amount to up to 7 percent of the starting salary. The performance bonus is paid retrospectively, as it were, when the performance has already been performed. The performance bonus can be paid up to the full amount of the official's starting salary. However, only 15 percent of civil servants in an office and a service are allowed to receive a performance bonus.

Hardship allowance

Special difficulties during the performance of an activity are compensated with the hardship allowance. These hardship allowances are both revocable and non-pensionable. If overtime is not compensated for by time off, it can be remunerated. However, this regulation does not apply across the board and without restriction. In Section 48 (1) BBesG, it is specified that remuneration for overtime is only paid if the type of overtime is measurable, i.e. verifiable.

Alternating shift allowance - shift work at changing times

The alternating shift allowance will be replaced by the new allowance for shift work. As a result, payment is made in retrospect, not in advance as before. The composition of the new allowance consists of an allowance for night work, an allowance for working hours during “dark hours” and an allowance for working hours on weekends and public holidays. The inferior hour service allowance remains unaffected and is paid in addition to the new allowance.

If you work at least three times a month on weekends or on public holidays, the employee will in future receive 20 euros as a lump sum per month.

What are the requirements for receiving the allowance for service at different times?

The basic requirement is that the employee must start work at least four times a month, which must be at least 7, but no more than 17 hours apart from the last start of work. The 4 service pairs can be spread over the month and do not need to be completed one after the other. In addition, the employee has to work 5 night shifts from 8 p.m. to 6 a.m. with the 4 service couples.

How are service pairs calculated?

The calculation is based on a complicated pattern. In principle, 4 service pairs can be distributed over the month. This means that an early shift in the first week can also be combined with a late shift in the fourth week. It is important that the starting time, calculated forwards, must be more than 7 hours. Calculated backwards, there must be no more than 17 hours in between.

Example of a service couple

Early shift: 5:45 a.m. - 2:00 p.m.
Late shift: 1:45 p.m. - 10:00 p.m.
There are more than 7 hours between 05:45 and 13:45 (forward calculation). Between 13:45 and 05:45 there are less than 17 hours in between (backward calculation).

Do shifts outside of the general duty roster also apply?

For the calculation of the new allowance for the service at changing times, working hours outside of the general duty roster, for example during working hours during a football game, also apply.

Will the allowance still be paid if the requirements are not met this month?

If there is a carryover from the previous month, the allowance will still be granted, even if the 4 duty couples and the 5 night shift periods have not been fulfilled.

I have more than 45 hours at night. What is happening to it?

From 45 night hours, the additional night hours are carried over into the next few months. A total of 135 night hours can be accumulated here.

What payment is made if the 45 night hours are not reached?

If the 45 night hours are not reached, the night hours are automatically increased by up to 45 hours from the carryover of the previous months.

How does the grant of half a day's vacation relate to 4 service couples?

If 35 hours of night were worked between 8 p.m. and 6 a.m. in the month and 4 pairs of duty were created, the employee receives an additional half day of vacation.

How does the additional break regulation behave?

If no 4 pairs of duty and 35 night hours have been worked per month, the employee does not receive any credit for the break.

I was unable to reach the 35 night hours due to vacation. Is there any compensation?

No, because the new hardship allowance regulation does not provide for any compensation regulations.
